Terms of Service

You must be at least 18 and able to enter a binding contract. SendGecko is built for professional use: creators, businesses, agencies and the people who work for them. If you sign up for a company, you confirm you can bind it, and “you” means both you and the company.

You can't use the Service if you are barred from doing so by law, or if we have ended your access before.

SendGecko helps you plan, adapt, schedule and publish content to social networks and messaging channels, with an optional AI helper (“Gecko AI”), a media library, a calendar, analytics and a link-in-bio page. The features and limits of each plan are on our pricing page.

• We use the official APIs of the networks and nothing else. We don't access your accounts with passwords, scrape, or automate likes, follows, comments or messages.
• We aim to publish within about a minute of the time you set. Networks and the internet sometimes delay or fail, so we don't guarantee exact timing, and if we can't be sure a post went out, we tell you instead of posting it twice.
• Until public launch, the Service may be in early access: some features may be incomplete, change or disappear, and we may limit who can join.
• We may improve, change or retire features. If we remove something you pay for in a way that matters, we'll tell you in advance.

• Give us true information and keep it up to date.
• SendGecko has no passwords. You sign in with a passkey, an email code or Google. Keep your email and devices secure, and tell us at once at contact@sendgecko.io if you think someone else got in.
• The person who creates a workspace is its owner. Owners and admins decide who joins and what they can do. You're responsible for what the people you invite do in your workspace.
• One account is for one person. Don't share it, sell it or transfer it.

When you connect a network, you authorise SendGecko to act for you on that account, but only to do what you ask: publish the posts you schedule and read your own performance numbers. You can disconnect at any time (see Data Deletion).

• You must follow each network's terms and rules, and you must have the right to post to the account, Page or channel you connect. Only connect places you own or administer.
• Networks decide, not us. They can change their APIs, limits, fees or rules, or remove content, restrict an account or reject a post. We aren't responsible for that, or for outages on their side. We'll tell you about changes that affect you.
• Network-specific terms. By connecting YouTube you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy applies. When you post to TikTok, you confirm the settings for each post and agree to TikTok's Music Usage Confirmation (and its Branded Content Policy if you label a post as commercial). Instagram, Facebook and Threads are covered by Meta's terms, LinkedIn by the LinkedIn User Agreement, Pinterest by its Terms of Service, and so on.
• Disclosures and labels. You're responsible for labelling paid partnerships, promotions and AI-generated content as the law and each network require.
• No affiliation. SendGecko is independent. It isn't sponsored, endorsed or operated by any network. Their names and logos belong to their owners.

You own what you create and upload (“Your Content”). We don't claim ownership.

To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to host, copy, store, process, resize, crop, format and transmit Your Content, and to send it to the networks and AI providers you choose, only to provide the Service to you. The licence ends when you delete the content or your account, apart from backups that expire on their normal schedule.

You promise that:

• you have all the rights you need to Your Content, including music, images, video, text and the likeness of people in it;
• it doesn't break the law, anyone's rights, a network's rules, or our Acceptable Use Policy.
• you will make the legally required disclosures (for example paid partnerships and AI labels).

We don't routinely read Your Content. We may look at it when you ask for support, when we investigate a report or abuse, or when the law requires it.

• Gecko AI creates suggestions with models from third-party providers that you choose. Suggestions can be wrong, odd or similar to other people's. Read and edit everything before you publish. You are responsible for what you publish.
• As between you and us, you own the output you get, to the extent the law and the provider's terms allow. We can't promise it is unique or free of third-party rights.
• AI never publishes by itself, except through an automation you set up and switch on.
• Credits. Using our keys spends AI credits from your plan or add-ons, as shown in the app. Your plan's monthly credits reset each month and don't roll over. Add-on credit packs don't expire.
• Your own key (BYOK). If you add your own provider key, you're responsible for its cost and for following that provider's terms. We store the key encrypted and use it only for your requests.
• Don't use Gecko AI to make content that breaks our Acceptable Use Policy or a provider's usage policy.

How AI requests are handled is explained in the Privacy Policy.

• Plans. SendGecko has a free plan and paid plans, with the prices and limits shown on the pricing page when you buy. Prices are in US dollars and exclude taxes, which are added at checkout where they apply.
• Payments are handled by our payment provider, Whop, under its terms. We never see your card number. Paid plans renew automatically each month or year until you cancel.
• Free trial. New accounts may get a 14-day trial of Pro without a card. When it ends you move to the Free plan, and nothing is deleted.
• Limits. If you go over a limit or move to a smaller plan, we pause what is above the limit instead of deleting it. You can upgrade or reduce usage to resume.
• Price changes. We'll give you at least 30 days' notice before a price change affects your renewal. You can cancel before it does.
• Lifetime plans. A lifetime plan is a one-time payment for that plan's features for as long as we operate SendGecko, subject to fair use. If we ever shut the Service down, we'll give at least 90 days' notice and a way to export your data.
• Payment problems. If a payment fails, we may pause paid features until it's fixed. If you think a charge is wrong, please write to contact@sendgecko.io first. We answer fast and will put it right.

Cancel any time from the billing portal (Settings → Billing → Manage billing). You keep your paid features until the end of the period you already paid for, then move to the Free plan. Your content stays safe.

Payments are non-refundable. We don't refund or credit part-used billing periods, unused features, AI credits that were used or have expired, or downgrades. Lifetime plans and add-ons are final once bought. That's why the free plan and the 14-day trial exist: please try SendGecko before you pay.

If we end your paid plan without cause, or if we stop the Service, we'll refund the unused part of your current paid period.

You must follow our Acceptable Use Policy. In short: no spam, no fake accounts or engagement, no posting to places you don't manage, nothing illegal or harmful, and every network's rules apply. Don't try to break, overload or bypass the Service or a network's limits, and don't resell the Service or build a competing product with it.

• You can stop using SendGecko at any time and ask us to delete your account (see Data Deletion).
• We may suspend or end access if you break these Terms or the Acceptable Use Policy, put the Service, other users or a network at risk, don't pay, or the law requires it. We'll tell you why when we can, and give you a chance to fix things unless the risk is urgent.
• After your account ends, you can export your data for 30 days (ask us if you can't find the option), and then we delete it as described in the Privacy Policy.
• Sections that by their nature should survive (ownership, payments owed, liability, disputes) survive.

The Service, including the software, design, the Gecko mascot and the SendGecko name and logo, belongs to PINTECH DOO Skopje or its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, reverse engineer or use our brand without permission.

If you send us feedback or ideas, we may use them without owing you anything.

The Service is provided “as is” and “as available”. To the extent the law allows, we don't make promises about uninterrupted or error-free service, about the results of your posts (reach, followers, sales), or about what networks, AI providers or other third parties do. We aren't a legal, tax or professional adviser.

To the extent the law allows:

• we aren't liable for indirect or consequential losses, lost profits, lost audience, lost data or business interruption, or for losses caused by a network or other third party (for example a suspended account, a changed API, or a post a network removed);
• our total liability for all claims relating to the Service is limited to the greater of what you paid us in the 12 months before the event and US$100.

Nothing in these Terms limits liability that can't be limited by law, such as for death or personal injury, fraud, or intentional or grossly negligent harm, or your statutory rights as a consumer.

If you use the Service for business, you'll cover reasonable losses we suffer because of a third-party claim that Your Content, or your use of the Service in breach of these Terms, infringes someone's rights or breaks the law. We'll tell you about the claim promptly and let you help with the defence. This section does not apply to consumers.

If you believe content in a SendGecko workspace infringes your copyright, write to contact@sendgecko.io with: who you are; the work and where we can find the infringing content; a statement that you have a good-faith belief the use isn't authorised; a statement, under penalty of perjury, that your notice is accurate and you're authorised to act for the owner; and your signature. We'll review it, may remove the content, and will tell the account holder, who can send a counter-notice. We end the accounts of repeat infringers.

We may update these Terms. We'll post the new version here with a new date. For changes that matter, we'll email workspace owners and show a notice in the app at least 30 days before they apply. If you keep using SendGecko after that, you accept the new Terms. If you don't, you can cancel before they start.

These Terms are governed by the laws of the Republic of North Macedonia, without regard to conflict-of-law rules. If we can't settle a dispute by talking first (please write to contact@sendgecko.io and give us 30 days), the courts of Skopje have exclusive jurisdiction, except that:

• if you are a consumer, you also keep the mandatory consumer protections and the right to go to the courts of the country where you live;
• either of us may seek urgent court orders anywhere to protect intellectual property.

• Whole agreement. These Terms, the Privacy Policy, the Acceptable Use Policy and (where it applies) the DPA are the whole agreement between us about the Service.
• If part is unenforceable, the rest stays in force. If we don't enforce something right away, that doesn't mean we gave up the right.
• Assignment. You can't transfer your rights without our consent. We may transfer ours to a successor of the business.
• Events beyond our control (outages of networks or infrastructure providers, disasters, government action) excuse delay or failure.
• Notices. We'll contact you at your account email or in the app. You can reach us at contact@sendgecko.io.
• Language. These Terms are written in English, and the English version prevails.
